Lien Request LLC

Terms of Service

Last updated September 13, 2026. These terms govern use of the LienRequest application at app.lienrequest.com and the ordering service provided through it.

Lien Request LLC is a Pennsylvania limited liability company that places, tracks and returns municipal and authority records requests — lien letters, tax certifications, utility payoffs and similar statements — on behalf of businesses closing real estate transactions. We are a records ordering service. We are not a law firm, a title insurance agency, or an abstractor.

1. Who these terms bind

These terms form an agreement between Lien Request LLC (“we,” “us”) and the business entity that registers for an account (“Customer,” “you”). Individual users log in under the Customer's company code; each of them acts for the Customer, and the Customer is responsible for what they do in the account.

The service is offered to businesses only — law firms, title agencies, lenders, real estate brokerages and similar. It is not offered to consumers and is not intended for personal, family or household use.

2. What the service is, and what it is not

On your instruction we prepare a written request to each issuing office, sign and send it as your agent, advance the office's fee where one is charged, track the request, and deliver the response to you through the application.

We do not:

No attorney–client relationship arises from use of the service. A lien letter is a statement by a government office of what its own records show. Amounts can be missed, misposted or assessed after the statement issues. Your examination of title and your closing decisions remain yours.

The same applies to inspections. Where the application indicates that a municipality has required a dye test, an occupancy certificate or any other inspection, it is reporting what past orders in that municipality involved. It is not advice that one is required here, and it is not a substitute for asking the municipality.

What we do not look at. We place the letters and report the inspections you select. We do not check, and nothing in the application should be read as addressing, zoning compliance or non-conforming use; open building permits, code enforcement violations or condemnation; rental registration or landlord licensing; fire, elevator, boiler or other safety inspections; stormwater, sidewalk, curb or street-opening obligations; historic district approvals; on-lot septic or private well requirements; or a condominium or planned community resale certificate under 68 Pa.C.S. § 3407 or § 5407, which is the association's to issue and not the municipality's. That list is not exhaustive either.

3. Your authority, and ours

By placing an order you represent that you or your client is a party to the transaction, or acts for a party, and that you have a lawful purpose for requesting the records. You authorize us to identify you by name in the request letter, to sign and transmit the request as your agent, and to receive the response on your behalf.

We may decline or withdraw any order. If we do so before dispatch you owe nothing for it.

4. The information you give us

We send what you enter. We do not independently verify the parcel number, record owner, municipality or property address you supply, and a request addressed on bad information will come back wrong or not at all. Where the application displays county assessment or GIS data, that data comes from the county as published, is provided to you as-is, and is not a substitute for the record itself.

5. Third-party offices and timing

Every issuing office is an independent third party. We do not control whether an office responds, when it responds, what it charges, or what it says.

Turnaround figures shown in the application are historical averages computed from completed orders. They are estimates and are not commitments. The “order by” date is the closing date less the eightieth-percentile historical turnaround for that office; it is an aid to scheduling, not a guarantee that an order placed by that date will return in time.

On the managed level, what we commit to is our own dispatch. On standard handling we prepare and mail a request within forty-eight (48) business hours of the order. On expedited handling we prepare and mail it the same business day, ahead of other work in our queue, and follow it up by telephone. The clock starts when the order is placed against a funded account, not when it is typed.

On the self-serve level we commit to preparation, not dispatch. The packet is ready to print as soon as the order is placed. When it is signed and mailed is yours, and no turnaround figure we show can account for it.

Those are the only timing commitments we make, because dispatch is the only part of the timeline within our control. Neither one is a commitment about when an office answers, and the expedited fee buys our effort rather than the office's. Some offices state in writing that they will not expedite at all; where we know that, the application says so before you select expedited handling.

6. Service levels

An account may be opened through the application or by arrangement with us. An account opened through the application is on the managed level; the self-serve level is enabled by us on request, because on that level requests are issued in your own firm's name.

You confirm, in opening an account, that you are authorised to do so for the firm named on it. We may decline to open, may suspend, and may close an account, and will return any unspent balance under Section 7 if we do.

Your account is on one of two service levels, stated when it is opened and shown on every order.

On either level, what we provide as to routing, fees and requirements is our record of what an office last charged and last required. It is not a representation as to what that office requires today, and is not legal advice. You remain responsible for what is requested and for reviewing what comes back.

We may change your service level only with your agreement. A change applies to orders placed after it, and does not alter the treatment of an order already placed.

6A. Your account, fees and payment

You fund an account with us before we place work, and every charge draws on it. We do not extend credit and, on the managed level, we do not advance the issuing offices' fees out of our own funds.

These amounts draw on the account:

On the managed level, between the moment you place an order and the moment its checks go out, the offices' fees are held against your balance rather than taken from it. The application shows that amount as committed. Nothing is committed on the self-serve level.

Funds you send are a prepayment for services and disbursements, not an escrow and not a trust deposit. We do not hold them in a segregated or fiduciary capacity, they are not client funds of yours held by us, and we act as your agent in paying the offices — not as an escrow agent or stakeholder for anyone. Your remedy in respect of an unspent balance is the refund described below. No interest accrues to you on a balance.

Fees charged by offices change without notice. The figure the application shows is the last amount that office charged on one of your orders. On the managed level, if an office charges more, we pay what it asks and the difference is taken from the account; if it charges less or returns the check, the account is credited, and either correction appears on your account statement. On the self-serve level the figure is a starting point for the check you draw and nothing more; confirm it with the office if it matters.

If the account will not cover an order, the order is refused rather than placed. We may, but need not, place an order against a short balance where funds are in transit; doing so once does not oblige us to do so again.

Statements are issued periodically — weekly unless we tell you otherwise — and show the opening balance, every movement in the period, and the closing balance. They are a record of what was charged, not a demand for payment, because the amounts have already been taken. You must raise a dispute as to any amount within thirty (30) days of the statement date; amounts not disputed in that period are treated as accepted. A dispute raised in time is credited or not on the merits, and we will not suspend the account over an amount properly in dispute.

Funding is by ACH transfer or check, payable to Lien Request LLC. We do not debit your account. Every transfer is one you initiate. We do not accept cards and we do not collect or store card or bank account numbers. If we add a payment processor we will name it in this section and in the Privacy Policy before taking any payment through it.

7. Cancellation and refunds

You may cancel an order at any time before the request is dispatched. The service fee is credited back to your account in full. On the managed level the offices' fees are released from committed without ever having been spent, because their checks had not been written.

Once a request is dispatched on the managed level, the fee paid to the office is generally not recoverable and stands as a charge whether or not the office responds. We will make reasonable efforts to recover a fee from an office that does not perform, but we do not guarantee recovery. On the self-serve level, recovering a fee from an office is between you and that office; we hold none of that money and can act on none of it.

You may ask for your unspent balance back at any time, for any reason or none, and we will return it within ten (10) business days of the request, less any amount then committed to orders already placed. Closing your account returns the balance on the same basis. A balance is not forfeited for inactivity and we charge no fee for holding, returning or maintaining one.

8. Your data

Order information you enter — property, parties, file numbers, notes and the responses we obtain — is yours. We use it to perform the service, to invoice, and as described in our Privacy Policy.

Aggregate operating data. We compile and keep statistics about issuing offices — the letters a municipality requires, the fee an office charges, and how long it takes to answer. These statistics describe government offices, not you, your clients or the properties, and they are derived from and retained across all orders on the platform. We may retain and use them indefinitely, including after your account closes. We will not publish, sell or disclose your order records, your client names, your file numbers or the properties you ordered on, and no statistic will identify you or any transaction.

On written request we will export your order records in a machine-readable format. On We retain your order records for three (3) years after the order closes and then delete them, except as we are required to keep them for tax, accounting or legal-hold purposes. Records that would answer a question arising more than three years after closing will not exist, so keep whatever your own file-retention rules require.

9. Accounts and security

Each person gets their own login. Credentials are not to be shared, and accounts are not to be issued to anyone outside your organization without our written agreement. You are responsible for activity under your company code. Tell us promptly at orders@lienrequest.com if you believe a credential has been compromised.

10. Acceptable use

Use the service only to obtain records for transactions in which you or your client has an interest. Do not resell access, scrape or bulk-extract the application, use it to assemble a competing dataset of offices, fees or turnaround times, probe it for vulnerabilities, or use it to obtain records for a purpose the issuing office would not permit.

11. Warranties

The service is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, that an office will respond, or that any response is accurate or complete.

12. Limitation of liability

Neither party is liable to the other for indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, lost business or loss of goodwill, even if advised of the possibility.

Our total aggregate liability arising out of or relating to the service, on any theory, is limited to the total service fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. Fees we paid to issuing offices on your behalf are not service fees and do not count toward that amount.

This limit does not apply to your obligation to pay amounts owed, to either party's liability for gross negligence or willful misconduct, to our breach of the confidentiality and data obligations in section 8 and the Privacy Policy, or to your indemnity obligations under section 13.

This section does not limit liability that cannot be limited under Pennsylvania law.

13. Indemnity

You will defend, indemnify and hold us harmless from any third-party claim, and any resulting loss, damage, liability, settlement, cost and reasonable attorneys' fees, arising out of or relating to: (a) information you supplied on an order; (b) your lack of authority, or your client's lack of authority, to request the records ordered; (c) your use of a record we obtained, including any decision made or advice given in reliance on it; or (d) your breach of section 10.

We will notify you promptly of any claim for which we seek indemnity, give you sole control of its defense and settlement, and cooperate at your expense — except that you may not settle a claim in a way that imposes any obligation or admission on us without our written consent, which will not be unreasonably withheld. Our failure to give prompt notice relieves you only to the extent you are actually prejudiced by the delay.

14. Term, suspension and termination

Either party may terminate on thirty (30) days' written notice. We may suspend an account immediately for non-payment after notice, for a security risk, or for a breach of section 10. Termination does not excuse amounts already owed, including fees charged on orders already dispatched, and we return the balance under Section 7. Sections 8, 11, 12, 13, 15 and 16 survive.

15. Changes to these terms

We may revise these terms. Material changes take effect thirty (30) days after we post the revision and send notice to the account's administrative contact. Continuing to place orders after that date is acceptance. If you do not accept, stop ordering and terminate under section 14.

16. Governing law and forum

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws rules. Each party submits to the exclusive jurisdiction and venue of the Court of Common Pleas of Westmoreland County, Pennsylvania, and the United States District Court for the Western District of Pennsylvania, and waives any objection to those forums on grounds of venue or inconvenient forum. EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS.

17. General

These terms, together with the Privacy Policy and any written rate schedule or order form, are the entire agreement between us on this subject and supersede prior understandings. If a provision is unenforceable, the rest stands. Neither party may assign without the other's written consent, except to a successor to substantially all of its business. Nothing here creates a partnership, joint venture or employment relationship, and our agency is limited to sending and receiving the records requests you place. There are no third-party beneficiaries. A failure to enforce a provision is not a waiver of it.

18. Notices

Notices to us go to the address below by certified mail or by email with confirmed receipt. Notices to you go to the administrative contact on the account.
